Terms of service

Draft. This text describes how the service works today and is being reviewed.

1. The service

Plantain ("we") provides an API that generates 1024×1024 images from text prompts ("the service"). Images are generated with third-party AI models (currently Google Gemini). Requests are queued and processed in batches. The service is for businesses and developers. You must be at least 18 years old to use it, and you may not offer it, or images from it, in a product aimed at people under 18.

2. Accounts and API keys

You can create an account by signing in with Google. The free trial credits are for one account per person or company. You are responsible for keeping your API key secret and for all use made with it. If you believe it has been exposed, sign in again to replace it, or tell us at hello@getplantain.com; the old key stops working at once.

3. Credits and payment

The service is paid with prepaid credits; one credit is used for each image requested. Prices are shown on our website; no VAT or IGI is added. Payment is made by card on a secure payment page hosted by our payment provider. A simplified invoice is issued for each purchase and can be downloaded after paying or through the API. Credits do not expire. Credits used for an image that fails or is declined by the model are returned automatically. See the refund policy.

4. Acceptable use

You must not use the service to create content that is illegal, sexually explicit involving minors, that infringes others' rights, harasses or impersonates real people, or that breaks the usage policies of the underlying model provider (Google's Generative AI Prohibited Use Policy). Prompts may be declined by the model. We may suspend accounts that break these rules.

5. Your content

You keep any rights you have in your prompts. Subject to applicable law and the model provider's terms, you may use the images generated for you for any lawful purpose, including commercially. AI-generated images may not be unique and may not be protected by copyright. We store images for 30 days so you can download them, then delete them.

6. Availability and quality

We aim to deliver images within one hour but do not guarantee delivery times or continuous availability. Images are provided as generated, without warranty of fitness for a particular purpose.

7. Liability

To the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

8. Changes and termination

We may change these terms or our prices with notice on this website; changes do not affect credits already bought at the earlier price. You may stop using the service at any time. We may end the service with 30 days' notice, in which case unused credits bought in the previous 12 months are refunded.

9. Law

These terms are governed by the law of Andorra. Consumers keep the protection of the mandatory law of their country of residence.
